A Nigerian Federal High Court has ordered that the National Communications Commission grants Mobitel Nigeria Limited a 2.3 GHz licence, according to local reports.
The judge reportedly declared the revocation and seizure of the licence as illegal, null and void and banned the sale of the frequencies to other parties.
Mobitel took legal action after the Minister of Information and Communications cancelled a licence award process on 25 May 2009 despite the fact that Mobitel fulfilled all the necessary conditions to acquire a slot of frequencies and paid N1.368bn.
The NCC sold blocks of 2.3 GHz frequencies to Mobitel, Spectranet and Multi-links.
The company was not immediately available for comments.
