Irish-owned mobile operator Digicel has started legal action against Cable & Wireless Communications in the Eastern Caribbean Supreme Court.
The local subsidiary, which operates under the Lime brand, is accusing CWC of anti-competitive behaviour.
Digicel said: “Our aim is to ensure that customers can benefit from best value mobile services. As such we issued legal proceedings….challenging the purported exclusive monopoly held by C&W on international calls coming in and out of Antigua and Barbuda.”
The company explained: “We sought various declarations from the court concerning the validity of C&W’s licence, as well as various declarations that the continued imposition of this international monopoly breaches fundamental provisions of the constitution of Antigua & Barbuda. As Digicel’s challenge is based on constitutional provisions and challenges to the licence as issued to C&W in 1987, we served those proceedings on the Attorney General of Antigua and Barbuda. We are not suing the Government of Antigua and Barbuda for damages or compensation relating to this matter.”
This is the latest in an ongoing series of legal wrangling between the two giants, the latest chapter of which saw Jamaica’s Supreme Court dismiss Lime’s request for injunctive relief in an ongoing case where it accused Digicel of anti-competitive behaviour.
