The Indian Telecom Dispute Settlement Appellate Tribunal (TDSAT) has given the green light for an appeal by Qualcomm on the Department of Telecom’s decision to void Qualcomm’s BWA licences application, according to reports.
Qualcomm had applied for such a licence following a successful bid for spectrum in the circles of Mumbai, Delhi, Kerala and Haryana in June 2010 for US$1bn.
The DoT reportedly refused to allocate the licence on the grounds that Qualcomm was late in filing the application and originally applied for four different licences, which was not allowed according to regulation.
In a statement to TelecomFinance in mid-September, Qualcomm said: “Qualcomm applied for ISP license on 9 August 2010, well within the three months window period as required by the NIA [National Investigation Agency], through the locally incorporated entities.
“Since DoT has not yet issued us the licence, and in the interest of expediting the licensing process, we have written a letter to DoT on 9 September 2011 agreeing to DoT’s interpretation of granting us one licence instead of four. Upon doing so, we would then merge the three other entities into the fourth, which would hold the licence,” it added at the time.
The next hearing is reportedly scheduled for 20 October.
