Portugal Telecom has won its appeal against a E38m fine, which it received in 2007 for abuse of its dominant market position.
The Lisbon Commerce Court granted PT a reprieve on the fine that had been issued by the competition authority for activities during 2003 and 2006.
Minority cable operators TvTel and Cabovisao had lodged complaints that PT was not allowing them to access its infrastructure during that time but the court found that there were no grounds on which to determine that this made them unable to provide fixed telephony, internet and pay-TV services.
