Telekom Austria has today [Thursday, 31 May] formally asked the Austrian antitrust regulator BWB for approval of the acquisition of Yesss!, the no frills MVNO of Orange Austria. A decision to either clear the deal or open a more thorough phase II investigation is due by the end of June.
Although structured as a separate transaction, the deal was announced the same day as the sale of Orange Austria to 3 Hutchison and was designed to reduce antitrust risks for the much larger Orange/Hutchison deal.
The latter is currently subject to an investigation by the European Commission, but the BWB has recently asked the Brussels based agency to refer the review to Austria.
The EC has to decide by 29 June whether to approve or reject the BWB’s referral request.
