UK ISPs BT and TalkTalk have asked for a judicial review of the Digital Economy Act, according to the BBC. Under this policy, assembled by UK regulator Ofcom, ISPs must send letters warning illegal downloaders of potential blacklisting and court action.
The two groups have called for the country’s High Court to clarify the act’s legality, suggesting it was “rushed through”, and questioning whether its proposals to stop illegal file-sharing harm “basic rights and freedoms”.
However, the code only applies to larger ISPs with more than 400,000 subscribers. TalkTalk executive director Andrew Heaney said his company, and other large providers, were at a disadvantage because of this: “It means we could have huge swathes of customers moving to smaller ISPs to avoid detection.”
