Hutchison Whampoa subsidiary Three Austria has chosen not to pursue its legal action against the Austrian government regarding last year’s 4G spectrum auction any further.
The operator took the decision to withdraw its appeal against the process in late June after it was signalled that some of the proceeds from the tender would be invested in broadband infrastructure.
Subsequently it was announced that €1bn would be put into improving the country’s networks.
Jan Troinow, Drei’s CEO, said his company continues to believe the auction was illegal in form and content, but decided to drop the lawsuit now that circumstances have changed.
Three Austria and rival T-Mobile Austria said the auction, which raised €2bn, said the sale suffered from a lack of transparency which led to inflated prices. Because of this they wanted the process to be re-run. T-Mobile has said its appeal still stands.
