The antitrust court case against the AT&T/T-Mobile USA merger brought forward by the US Department of Justice might not be heard in February already, according to reports.
Media wrote that in a hearing on Friday last week, the DoJ asked for the actual court case to be postponed. A lawyer speaking for the DoJ argued that a fast-track procedure for the case was no longer required, given that the companies withdrew their separate application for FCC approval regularly.
The companies decided to withdraw their filing with the FCC recently after it became clear that the telecoms regulator was seeking to block the transaction. They do, however, require the FCC’s green light prior to closing of the proposed transaction.
Judge Ellen Huvelle will now consider if she follows the DoJ’ request, the reports said. A further hearing is scheduled for Thursday.
