AT&T and Deutsche Telekom have asked the US district court to halt proceedings on a lawsuit against the AT&T/T-Mobile USA deal so that both the US telco and the German incumbent can “evaluate all options”.
The lawsuit was originally filed by the Department of Justice in August. The DoJ joined AT&T and DT in the new filing asking for proceedings to be halted.
The judge for the case, Ellen Segal Huvelle, subsequently ordered that the legal action be stayed. A “status conference” on the case will be held on 18 January.
The order also stated that AT&T should file a status report, giving an update on the current situation with the deal, by 12 January.
This report should include “discussion of whether they intend to proceed with the transaction at issue in this litigation”.
In a statement, AT&T said that it was committed to working with Deutsche Telekom to find a solution in the best interests of customers, shareholders and employees.
“We are actively considering whether and how to revise our current transaction to achieve the necessary regulatory approvals so that we can deliver the capacity enhancements and improved customer service that can only be derived from combining our two companies’ wireless assets,” AT&T said.
