T-Mobile Austria, the country’s second-largest mobile operator, is challenging some terms of the upcoming 4G auction.
The regulator is looking to raise approximately €526m (US$697m) from the auction of spectrum in the 800 MHz, 900 MHz and 1800 MHz bands, scheduled for September and open to established players as well as a new entrant.
The licence period itself is expected to start in January 2016, for most of the spectrum.
But some of these frequencies are still being used by T-Mobile and “we firmly believe that our present licensing conditions give us the right to use these frequencies until 31 December 2019,” a spokesperson for the company said in an email.
The regulator reportedly has six months to respond to the complaint, which was filed a few weeks ago. Some of the spectrum to be auctioned also belongs to Telekom Austria and Hutchison’s 3, according to Reuters.
It is so far unknown whether the 4G auction will be delayed as a result.
