T-Mobile Austria has appealed a decision by the Austrian telecoms regulator TKK clearing the transfer of frequencies in the context of the sale of Orange Austria.
The T-Mobile subsidiary confirmed the move in a blog post, saying the transfer of frequencies from Orange to Hutchison and from Hutchison to Telekom Austria (TA) would distort competition.
The TKK decision would allow Hutchison and Telekom Austria to expand UMTS 2100 and LTE 2600 based services faster and cheaper than T-Mobile, the company argues, resulting in a significant advantage for the competitors. T-Mobile would have to invest €90m in order to compete with TA and Hutchison.
T-Mobile said it appealed to the higher administrative court because the TKK had denied it the opportunity to raise its concerns in due course of the investigation. It has asked the court to declare the TKK clearance not final until a decision on the appeal has been made. A decision is expected within days.
