Brazilian telecom regulator Anatel has rejected attempts by existing mobile operators to take part in the auction for the Band H 3G mobile spectrum.
On October 26, Anatel opened the bidding for a tranche of 3G spectrum known as Band H, as well as some supplementary 2G licences, saying that it hoped to encourage newcomers to apply for the licence.
In early November, both Telemar Norte Leste (owner of Oi) and SindiTelebrasil, a union representing Brazilian telephone companies and workers, both appealed against Anatel’s decision.
On November 30, they obtained an injunction from a federal court in Brasilia, which forced Anatel to review their appeal on the issue of the Band H spectrum, according to local newspaper Brasil Economico.
The publication reported on Friday that Anatel, after making this review, had still decided to reject these appeals. Sinditelebrasil said it would examine the legal and technical results of the ruling before deciding whether to continue fighting to open up the auction.
Anatel was unavailable for comment by press deadline. The auction is due to take place on December 14.
