Mexican number three mobile operator Iusacell has vowed to continue its legal battle with telecoms ministry SCT and regulator Cofetel over the award of the recent award of a 30MHz in the 1.7GHz band licence to Nextel/Televisa.
Salvador Rocha, a lawyer for Grupo Salinas, the controlling entity behind Iusacell told Dow Jones that the legal battle was “just beginning”, suggesting that future action could even include charges being brought against the government officials that awarded the licence.
Salinas believes that the terms of the auction, which saw only one bidder gain qualification, violated laws defending free competition and requiring that the government obtain the maximum benefit from the sale of national assets.
Despite Iusacell’s efforts to challenge the award, the licence was issued by the SCT on October 1.
