The European Commission is to send a letter of formal notice to Poland on the grounds that telecoms regulator UKE may have failed to respect consultation obligations on wholesale broadband access tariffs.
On April 12, UKE adopted a decision which fixed TPSA’s wholesale broadband access tariffs and the way they are calculated. The decision also set the rules for conducting price and margin squeeze tests in line with an agreement signed between UKE and the telecoms incumbent last October on non-discriminatory treatment of alternative operators.
However, the draft has not been made available for consultation with stakeholders at the national level or to the Commission, which must be informed of draft measures affecting trade between member states.
