The Austrian constitutional court has rejected an appeal by several local mobile operators to make a decision whether or not last year’s frequency auction was constitutional.
A parallel appeal with the administrative court is still pending.
According to T-Mobile Austria, which filed the cases alongside Hutchison 3 Austria, the court argued that the case was not within its area of responsibility as the constitution was not affected.
T-Mobile takes the view that the 4G auction, which raised more than €2bn for the state, suffered from a lack of transparency. This led to inflated prices and the auction should therefore be annulled.
T-Mobile spent €650m on frequencies in the 2013 auction, Hutchison spent €330m and Telekom Austria, which has not joined the complainants, spent €1.03bn.
